Welcome to Subspaces. By accessing our website at subspaces.app, you agree to these Terms of Service. Please read them carefully.

These Terms of Service ("Terms") govern your use of our platform and services. Our Privacy Policy also governs your use of our service and explains how we collect, safeguard and disclose information resulting from your use of our web pages.

2. Services

Subspaces provides an SVG generation platform with both free and premium features. We offer template customization, color palette selection, and AI-powered SVG generation.

Our services allow you to create, customize, and download SVG designs for your personal or commercial use. We may update, change, or enhance parts of our services at our discretion and may introduce new features or impose limitations on certain features.

3. Account Terms

You must be at least 18 years old to use this service. You are responsible for maintaining the security of your account and password. We cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

When creating an account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify us immediately of any breach of security or unauthorized use of your account.

4. Billing and Fees

For paid features, we use third-party payment processors to bill you. By subscribing to our premium plan, you agree to pay all fees in full. Fees are non-refundable except where required by law.

Premium subscriptions will automatically renew for successive monthly periods unless canceled beforehand. You may cancel your subscription at any time through your account settings or by contacting us.

We reserve the right to change our subscription fees at any time. If we do change fees, we will communicate any price changes to you in advance and provide you with the opportunity to cancel your subscription before the price change goes into effect.

5. Free Trial

We may offer a free trial of our premium features. At the end of the trial period, you will be automatically charged for a subscription unless you cancel before the trial ends.

You may be required to enter your billing information to sign up for the free trial. If you do not cancel your subscription before the end of the free trial period, you will be automatically charged the subscription fee for the type of subscription you signed up for.

6. Intellectual Property

The service and its original content (excluding content provided by users) are the property of Subspaces and are protected by copyright, trademark, and other laws.

SVGs you create with our service belong to you. However, you grant us a license to use them for service improvement and promotional purposes. This license allows us to display your designs (with attribution when possible) in our marketing materials, social media, and website.

Our templates, even when customized by you, remain our intellectual property. While you own the specific design you create, the template structure and code remain our property.

7. Commercial Usage Rights

Users may freely use any SVGs created using our platform for both personal and commercial purposes without additional licensing fees, royalties, or attribution requirements. This includes using the SVGs in commercial products, websites, applications, marketing materials, or any other commercial context.

There are no restrictions on how you may use, modify, or distribute the SVGs you create. You may incorporate them into commercial products, sell them as part of a larger work, or otherwise monetize them without owing any additional fees or royalties to Subspaces.

8. AI-Generated Content

Our platform utilizes AI technology to generate and customize SVG designs. By using our AI-powered features, you acknowledge and agree that:

  • The AI-generated SVGs you create using our platform belong entirely to you, with the same rights as other content created on our platform
  • We do not use your generated SVGs to train our AI models without your explicit consent
  • While we strive to ensure AI-generated content is original, we cannot guarantee that AI outputs might not resemble existing works
  • You are responsible for reviewing AI-generated content before using it in commercial contexts

9. Template vs. Output Distinction

It is important to understand the distinction between our templates and your output designs:

  • Templates: The underlying templates, algorithms, code structure, and generation mechanisms remain the intellectual property of Subspaces
  • Output: The specific SVG images you generate and customize belong entirely to you, with full commercial and personal usage rights
  • You may not reverse-engineer or attempt to extract our template algorithms or code structure
  • You may freely use, distribute, modify, and commercialize the SVG outputs you create with our templates

10. User Content

You retain ownership of any content you generate using our service. By submitting feedback about our service, you grant us an unlimited, irrevocable right to use this feedback.

You are solely responsible for your user content and the consequences of posting or publishing it. By posting content, you affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize us to use all intellectual property rights in and to any content you generate.

11. Prohibited Uses

You may not use our service for any illegal purposes or to violate any laws. You may not attempt to gain unauthorized access to any portion of the service or disrupt the functioning of our platform.

Additionally, you agree not to:

  • Use the service to transmit any malware, spyware, or other harmful code
  • Impersonate any person or entity or falsely state or misrepresent your affiliation
  • Interfere with or disrupt the service or servers or networks connected to the service
  • Harvest or collect user information without their consent
  • Use our platform to generate content that is offensive, harmful, or violates others' rights

12. Termination

We may terminate or suspend your account at any time, with or without cause and without prior notice. Upon termination, your right to use the service will cease immediately.

If you wish to terminate your account, you may simply discontinue using the service, or contact us at [email protected]. We may retain certain information as required by law or as necessary for our legitimate business purposes.

13. Limitation of Liability

To the maximum extent permitted by law, Subspaces shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

In no event shall our total liability to you for all damages, losses, or causes of action exceed the amount you have paid us in the last six months, or $100 if you haven't purchased anything from us.

14. Warranty Disclaimer

The service is provided "as is" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable, or that the quality of any products, services, information, or other material obtained through the service will meet your expectations.

15. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located within the United States. By using our service, you consent to the jurisdiction and venue of these courts.

16. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of significant changes by updating the date at the top of this page. Your continued use of the service after such changes constitutes your acceptance of the new terms.

It is your responsibility to review these Terms periodically for changes. If you do not agree to the revised terms, please stop using our service.

17. Indemnification

You agree to defend, indemnify, and hold harmless Subspaces and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.
